However, recently, there was a case where 1 resident at the same time had a CCCD with a chip and a valid ID card, without cutting corners. People wonder if they can use CCCD with chip and ID card in parallel?

Penalties for using ID card and CCCD with chip at the same time

The representative of the leadership of the Police Department for administrative management of social order (PC06) of the Ho Chi Minh City Police Department said that according to the provisions of Clause 3, Article 11 of Circular 59/2021/TT-BCA, the ID card will be collected. CCCD card is in use in case citizens carry out procedures to change from ID card to CCCD card, change CCCD card.

At the same time, Clause 8, Article 5 of Circular 60/2021/TT-BCA also stipulates that the old ID card/CCCD will be revoked in case citizens carry out procedures to change from ID card to CCCD card or change CCCD card.

Previously, when making CCCD, only the case of ID card was damaged, peeling, unclear (photo, ID number and text) was revoked. When returning the completed CCCD card to the people, the officer receiving the dossier requests the citizen to submit the appointment letter to return the CCCD card together with the ID card and proceed to cut the upper right corner of the front of that ID card, each square corner. is 2 cm, record it in the file and return the cut ID card to the person who comes to receive the CCCD card.

However, at present, when citizens carry out the procedures to switch from ID card to CCCD, the old ID card will be revoked, so it is not possible to use both ID card and CCCD with new chip at the same time, this regulation applies from July 1, 2021.

A representative of PC06 leadership said: “The ID card is no longer valid when people have received a CCCD card with a chip”. Therefore, people should use CCCD chip for transactions to avoid later having to carry out procedures to change information to CCCD number and also avoid trouble later.

Not only that, people may be subject to a warning or a fine of between VND 300,000 and 500,000 for failing to comply with regulations on granting, changing and re-granting CCCD cards according to the provisions of Point b, Clause 1, Article 10 of Decree 144. 2021/ND-CP on December 31, 2021.

Rights and interests affected, vulnerable to forgery of documents

When signing all kinds of contracts of sale, transfer, purchase and sale transactions … people use old ID cards (no longer valid, instead of using CCCD with chips that have been issued) if it happens later if it happens. In the event of a dispute, the disputing party will use the reason “CNMD has expired, there is no value to prove the identity in the transaction” to request the competent authority to declare the transaction invalid, and even demand compensation for damage.

Another case is when this document falls into the hands of outsiders, or as long as they have your old ID card or CCCD information, it can be easily faked to be used for fraudulent purposes, borrowing money…

In addition, the use of old ID cards and CCCDs to declare and register for public administrative procedures easily leads to inconsistent information (between the old CNMD and the CCCD with the new chip) so it can cause difficulties for people. for future updates.
