The Ministry of Information and Communications has issued Circular 22/2021/TT-BTTTT detailing a number of articles of Decree No. 91/2020/ND-CP of the Government on combating spam messages, spam emails, spam calls. The Circular took effect from March 1, 2022.

Circular guides users to reflect and provide evidence of spam messages. Accordingly, the user composes a reflection message according to the syntax: S [Distribution source][Spam message content] or S (distribution source)(Spam message content) to 5656.

Registration syntax: DK DNC to 5656 and cancellation syntax: HUY DNC to 5656.

Besides, users can register or cancel via website khongquangcao.ais.gov.vn or call center or application.

The advertiser is only allowed to send the first and only advertising registration message to a number of subscribers. Within 24 hours from the time of sending the first and only advertising registration message, if the user does not respond, the advertiser is not allowed to send any advertising registration or advertising messages to the number that phone.

According to Decree 91/2020, the act of sending advertising registration messages in contravention of regulations of the Ministry of Information and Communications, or sending advertising registration messages to phone numbers on the No-advertising List will be punished. fined from 60-80 million VND.

Meanwhile, the acts of calling advertising to users without consent / refusing to receive calls, or sending advertising registration messages when users have refused / not answered to receive messages, will be fined from 5-10 million VND.

Acts of making more than 1 advertising call to 1 phone number within 24 hours without another agreement with the user will be fined with an amount of 20-30 million VND. Similarly, the act of calling advertising outside the period from 8 am to 5 pm every day without another agreement with the user will also be fined from 20-30 million dong.
