In the case of a fine of up to 6 million VND when using a CCCD with a chip installed in the wrong way, people need to pay special attention

According to Decree No. 144/2021/ND-CP on sanctioning of administrative violations in the field of social security, order and safety; Prevention of social evils; fire protection and prevention; rescue and rescue; domestic violence prevention and control.

The following cases will be sanctioned for violating regulations on issuance, management and use of identity cards or citizen identification cards (with chip or without chip).

1. Failure to change the citizen ID upon expiration may result in a fine of up to VND 500,000

Specifically, a warning or a fine of between VND 300 and 500 thousand for one of the following acts:

– Do not present ID card, ID card, CCCD card or Certificate of ID number when requested to check by a competent person.

– Failing to comply with the provisions of law on granting, changing and re-granting CCCD cards.

– Failing to return the ID card or CCCD card to the competent authority when it is granted, has its nationality revoked, or the decision for naturalization in Vietnam is revoked; failing to return the ID card or CCCD card to the custody or temporary detention order enforcement agency, prison sentence enforcement agency, or decision enforcement agency. obligatory.

2. A fine of between VND 1 and 2 million for one of the following acts:

– Appropriating and using ID cards, ID cards, CCCD cards or Certificates of ID numbers of others;

– Erasing, correcting or other acts that falsify the contents of the ID card, ID card, CCCD card or Certificate of ID number.

– Destroying, intentionally damaging the ID card, ID card, CCCD card or Certificate of ID number.

3. A fine of between 2 and 4 million dong for one of the following acts:

– Forging, using fake papers, documents and data to be issued with ID card, ID card, CCCD card or Certificate of ID number confirmation.

– Providing false information and documents in order to be issued with ID card, ID card, CCCD card or Certificate of ID number confirmation.

4. A fine of between VND 4 – 6 million for one of the following acts:

– Forging ID card, ID card, CCCD card or Certificate of ID number confirmation but not being prosecuted for criminal liability.

– Using ID card, ID card, CCCD card or Certificate of fake ID number.

– Mortgage, pledge, pledge ID card, ID card, CCCD card or Certificate of ID number.

– Buy, sell, rent, lease ID card, ID card, CCCD card or Certificate of ID number.

– Borrowing or lending ID cards, ID cards, CCCD cards to commit acts contrary to law.

In addition to the form of warning and fine mentioned above, violations related to the issuance, management and use of CCCD/IDs are also subject to additional sanctions and remedial measures as prescribed.
