In May, Meta Platforms lost a legal battle when the European Court of First Instance ruled that the EC’s request for information related to an investigation into Facebook’s data and online marketplaces was legitimate.

The lawsuit dates back to 2020 when the EC began examining Meta’s sales platform and how it used data from applications. Meta claims to have collaborated and handed over more than 1 million documents, but sued the EC in 2020 on the grounds that the data requests were very wide in scope. Regulators may require companies to provide material that mentions certain keywords at risk of penalties.

However, the European Court of First Instance held that authorities could not force Meta to hand over potentially sensitive documents without considering details. Accordingly, the court ruled that the EC should work with Meta and store the information in a virtual data room.

In its latest ruling, the Luxembourg-based court ruled that Meta Platforms Ireland had not yet proven that the request to provide documents identified by search terms was excessive. The court also stated that Meta had not been able to prove that setting up a virtual data room did not ensure that sensitive personal data was kept strictly confidential.
