According to Article 2 of Decree 05/1999/ND-CP as amended and supplemented by Decree 170/2007/ND-CP, the ID card is valid for 15 years from the date of issue (whether it is a 9-digit or 12-digit ID card). ).

Meanwhile, from January 1, 2021, the Ministry of Public Security has issued CCCD with chip instead of ID card and barcode CCCD. Accordingly, citizens who are granted IDs and CCCD barcodes from the end of 2020 can continue to use them until the end of 2035. From 2036, ID cards and barcode CCCDs will be officially “dead” and the use of ID cards and CCCDs will be Barcodes after this point are prohibited .

Thus, from 2036, citizens who have not changed to CCCD with a new chip will certainly be fined.

Besides, Vietnamese citizens from full 14 years old are granted CCCD cards, however CCCD cards are not valid for life. When reaching a certain age, citizens must carry out the procedure to change a new CCCD card. According to current regulations, all citizens who change their old ID card and barcode CCCD will all be replaced with a chip-mounted CCCD.

Term of chip-mounted CCCD

According to the provisions of the Law on Citizen’s Identity 2014, the Ministry of Public Security has issued a model of a CCCD card with a chip with an expiry date according to the principles of Article 21 of the Law on CCCD 2014 as follows:

– CCCD card must be changed when the citizen is full 25 years old, full 40 years old and full 60 years old.

– In case a citizen identification card is issued, changed or re-issued within 2 years before the age specified above, it is still valid until the next age of card change.

Accordingly, CCCD, whether it is a barcode or a chip, has an expiration date until the grantee is full 25 years old, full 40 years old and full 60 years old. But if it has been issued for 02 years before these age milestones, it can still be used until the next age milestone.

Some special cases

If a citizen goes to work for a CCCD card with a chip at the age of 24, the CCCD card with this chip is valid until the citizen is 40 years old.

If in the case of a citizen who works for CCCD with a chip, he is 60 years old, by the time of card issuance, the validity of the card is for life. That is, citizens can use it until they lose it without having to change the card again, unless the card is lost, or damaged, etc.

Citizens who work CCCD chips when they reach the age of 58 can also use the card until they die, without having to change the card at the age of 60.

Citizens over 60 years old who are using barcode CCCD can continue to use it until death, without having to change to chip CCCD.

The expiry date of the bar-coded citizen identification card previously issued according to the provisions of Article 4 of Circular 06/2021/TT-BCA and the Law on Citizenship Identity 2014 stipulates as follows:

– ID card, CCCD bar code issued before the locality deploys the issuance of CCCD card with chip, it is still valid until the expiry date.

Therefore, people who have ID cards and CCCDs issued according to the old form, if they have not expired, are not required to change to CCCD with chip.

What is the penalty for not changing CCCD when it expires?

According to Point b, Clause 1, Article 10 of Decree 144/2021/ND-CP and Article 23 of the Law on Citizenship Identity 2014, from 2022, failure to change CCCD upon expiration will result in a warning or a fine of from VND 300,000 up to 500,000 VND.
