Regarding the legal responsibilities of organizations and individuals in using social networks, on June 12, 2018, the National Assembly promulgated the Law on Cybersecurity, which stipulates prohibited acts, including Untrue information causes confusion among the people, causes damage to socio-economic activities, causes difficulties for the operation of state agencies or official duty performers, infringes upon legitimate rights and interests. of other agencies, organizations and individuals.

Article 42 stipulates that agencies, organizations and individuals using cyberspace must comply with the law on cybersecurity.

Next, on June 17, 2021, the Ministry of Information and Communications issued the Code of Conduct on social networks.

The purpose of the Code is to create conditions for the healthy development of social networks in Vietnam, to ensure personal freedom, freedom of business, and non-discrimination against domestic and foreign service providers. country, in accordance with standards, practices and international treaties to which Vietnam has acceded; building ethical standards of behavior and conduct on social networks, educating awareness, creating positive habits in the behavior of users on social networks, contributing to building a safe online environment. , healthy in Vietnam.

The scope of the Code is the behavior of individuals and organizations on social networks. The subjects of application are state agencies, cadres, civil servants, public employees and employees in state agencies using social networks; other organizations and individuals using social networks; social network service provider in Vietnam.

Then, on December 13, 2021, the Ministry of Culture, Sports and Tourism issued a Code of Conduct for people operating in the field of art.

Among the rules that require individuals to use social media accounts to interact, they must share, post and provide accurate, reliable information that is beneficial to society and the country; commenting and commenting properly, culturally and responsibly on issues of concern to the public; truthfulness in speaking, expressing and sharing correct and objective views; do not post, share and spread content that violates the law, false information, copyright infringement, unverified information, insults honor, personal dignity and negatively affects, infringing upon the legitimate rights and interests of organizations and individuals.

Regarding the assurance of security and information safety, and the prevention and combat of crimes and violations of the law on the internet, the Ministry of Public Security said that from the beginning of 2022 until now, the force of cyber security and crime prevention and control Using high technology, 474 cases and 1,071 defendants were detected and prosecuted for being involved in crimes using high technology to infringe on social order and safety.

In recent years, the spread of fake news and false news on the internet and social networks is complicated and increasing. Fake news (fake news) attacks network users. Facing that situation, the Ministry of Public Security has directed forces at units and localities to strengthen monitoring and scanning information on social networks, promptly detect and strictly handle individuals and organizations in the locality. The law cannot cover and regulate all human behaviors, including how to behave on social networks, but it also needs to be adjusted from the perspective of ethical and cultural standards of a community. , ethnic.

Thus, people may not fall into the “criminal domain”, “the law-breaking domain” but fall into the threshold of moral and cultural deviation.

To handle an act legally, that act must satisfy the elements constituting a crime, violating the law. However, there are many behaviors that deviate from ethical and cultural standards on social networks that the Law on Cybersecurity as well as the code of conduct do not detail and do not stipulate as violations of the law. For example, an insensitive attitude, lack of humanity, slapping water in the rain, accidentally “rubbing salt” into the pain of others, being overly curious, prying into private life…

In human nature, there is both good and evil that the law alone cannot regulate and deter, but need the supplement and support of ethical and cultural standards. To manage social networks effectively, it is necessary to closely and harmoniously combine the law with ethics and cultural background.

Ethical and cultural standards are unwritten social norms – its rules and requirements are not recorded in writing in the form of a “moral code” but exist in the form of values. moral values, lessons on moral ethics, reciprocal behavior between people in society. Ethical and cultural standards are often consolidated, preserved and promoted through the educational path, through the process of contact in society; consolidated, absorbed and handed down from generation to generation, from generation to generation.

According to legal experts, there are legal and ethical standards in society. Ethical and cultural standards have both subjective and objective factors.

Subjective factors exist in the consciousness and views of each individual, which govern and control ethical behavior. It is the voluntariness and self-discipline of each human being in the performance of ethical behavior in accordance with the rules of ethical standards in society. If the law is obeyed and implemented mainly thanks to the coercive power of sanctions, moral standards are mainly based on the voluntariness and self-discipline of each individual. It is an inner strength, governed by the conscience of each person. Conscience is a special kind of “court”, specializing in judging wrongdoings and violations of moral standards. A violation of moral standards may not be punished by law, but it is tormented by conscience.
